Alan King and Chelsea Gauger represented Bisanz Brothers Management and Humboldt Woods Home Owners Association in a case initiated by a former homeowner.
In Jennifer George v. Bisanz Brothers Management and Humboldt Woods Association, Plaintiff sought money damages for water damage that occurred in the basement after Plaintiff purchased her townhome. Mr. King demonstrated that Plaintiff’s present claims for damages were barred by a valid release, which Plaintiff previously signed in exchange for a settlement award. Plaintiff’s claims related to water damage in the basement were denied.
Plaintiff also sought replacement costs for a garage door and exterior deck. Mr. King showed that the governing Declaration did not impose liability upon Defendants. Plaintiff’s claims concerning the garage door and deck were denied.
Judgment was entered in favor of Defendants, and Plaintiff’s case was dismissed with prejudice.
