Deborah Eckland and Matt Nelson represented a masonry contractor in a personal injury lawsuit brought by a demolition company worker. The case settled at mediation. Thereafter, the worker’s employer claimed its attorney did not have authority to settle the claim and extinguish its right to recover increased insurance premiums as a result of the accident. The Minnesota Court of Appeals held that the district court did not err when it enforced the settlement agreement and determined that the employer’s attorney had authority to enter the mediated settlement under Minn. Stat. § 481.08 (2018).
